View Full Version : Transworld Systems class action - KEEP your collection letters
Christine
This is an OLD action from 2000, but it is rather interesting as I've seen MANY collection letters without the statement advising of the right to dispute the debt.
Details of the claim and proposed settlement are at http://www.notice.com/TRANSWORLDSYSTEMS/
Does anyone have a link to the final settlement? I'd sure like to know how much each consumer got.

I read the Miranda type warning but can't see the issue that got these CA in trouble. What am I missing? Looks similar to something I saw this last week ---but it wasn't for me!!

"Plaintiff alleges that TSI violated the Fair Debt Collection Practices Act ("FDCPA"), 15 U.S.C. §§ 1692g(a)(3) and (a)(4) by allegedly failing to inform consumers that they may dispute or request verification of "any portion" of an alleged debt."
Their notice read:
"TRANSWORLD SYSTEMS INC. IS A LICENSED COLLECTION AGENCY AND ANY INFORMATION OBTAINED FROM YOU WILL BE USED FOR THE PURPOSE OF COLLECTING THIS DEBT. ALL PORTIONS OF THIS CLAIM SHALL BE ASSUMED VALID UNLESS DISPUTED WITHIN THIRTY DAYS OF RECEIVING THIS NOTICE. IF DISPUTED IN WRITING, VERIFICATION OF THE DEBT WILL BE PROVIDED TO YOU. IF THE ORIGINAL CREDITOR IS DIFFERENT FROM THE ABOVE NAMED CREDITOR, THE NAME AND ADDRESS OF THE ORIGINAL CREDITOR WILL ALSO BE PROVIDED."
Of course it's ALL CAPS so that people don't read it in the first place.
