I spoke at length with my attorney yesterday and he advised me to file Chapter 13 as my debt to income isnt large enough for a chapter 7. Thats no big deal to me,I guess.
I was given paperwork which included listing all debts with account numbers,addresses,etc. If a debt is in collection,should I give the collection companies account number along with their address? I can`t find addresses for some of my creditors nor account numbers.Hopefully,collection numbers will do.I have taken any account number I could off of my 3 CRA reports to ensure they will be included.

I am about to purchase a land contract. This would not obviously go through any financial institution,and it would become my primary residence.I would have to pay $480 a month for the place.I can use this as my rent allowance,I believe,as this is where I`ll live.Will it affect the person I`m buying from? Any ideas on how this should be presented to the courts? Should I do this prior to filing or wait?

I want to have this done on the 3 year repayment plan. What sets the length of time I can repay?

I`m stuck on whether or not to file.I do have negative items on my report,but probably half of them will be removed within the next year through either 7 year rule or disputes on my part.My current Fico is a whopping 480,and believe me I didnt work hard to get there. I have 3 judgements,2 of which will be gone from my report next year.

If I call my creditors aand tell them of my plan to file bk,will they arrange repayment with me in lie of re stating items on my report? In other words,If one of my creditors has a judgement on my report,and I ask them to remove the item and I will repay them x amount of the money owed,will they ever do that? I would love to be able to do this,and am going to approach some creditors about this,but not sure if its advisable.

Calling the creditors is a waste of time, just file.

I know nothing about repayment plans, and I highly recommend getting at least 2 legal opinions.

And order your credit reports for creditor info, notify everybody.

Thanks Christine. I am leaning towards just filing the 13 and telling all the harrassing creditors to stuff it. The lawyer said i would probably have to pay $250 a week for 3 years,but that will include paying for my 2001 truck.
