View Full Version : Going after NCO Financials!

Here's where I'm at with NCO Financials ( CA ):
I requested validation on a medical collection they are reporting to Equifax and TU. I didn't get anything from them ( been over 3 months ).

I contacted OC and requested itemized statement and signature. They sent me the usual " printout ". No itemization; no signature.

I disputed with TU, and I just got my new report yesterday. Of course, CA verified, no change. I noticed that TU has last date reported still listed as 3/2001. Don't know how they verified it in 8/2002!

Anyhow, I just mailed out my next round to Equifax, and I want to see if they verify to them too. If I keep giving them rope, they will continue to completely hang themselves!

After Equifax comes back, I will do my 3 day delete or be sued, citing all of the FCRA and FDCPA violations to date. I will also request a nice settlement $$$$, and go to court if necessary

Keep you posted......................

I can assure you that it's highly unlikely that NCO will just send you a check.

Their continuing to report and verify after they received the validation request is a FDCPA violation - specifically listed in the FDCPA.

Since it's extremely unlikely that you'll get more than your $1,000 for statutory damages, I think you're wasting your time listing all these violations, doing all those disputes - unless you file in "real" court (not small claims) and are willing to go all out.

I've never NOT gotten the deletion letter from NCO after the validation request was ignored and I sent a 3 day letter a few weeks later.

I think people waste way too much energy on getting deletions. If you're talking judgments or big checks, that's a different story :)
