I had a bogus charge off deleted from both Equifax and TransUnion. It was for wireless phone service that was constantly terrible, and upon reviewing my account, the company finally credited me, seeing that something was definitely wrong.

The problem I am having is Experian VERIFIED this account as a legitimate charge-off. The original creditor told me to go ahead and dispute with the CRA's and they would not verify the charged-off account as mine. They could not update the account themselves. I know that is bogus, but now I am left with the charge-off on Experian, and they WILL NOT re-investigate this account at all again. They state via Customer Service Rep, that the account will stay on for the full 7 years.

The affiliate office that handles my credit report, Credit Data Services out of Orlando, FL. will not reinvestigate ANY account that I request them to. Seems that If they "verify" the account once, they feel that is all they have to do. Well, they don't "verify" anything. I am positive they just wait til' the 30th day, and say oops, forgot this one, and just report "remains"; verified on such and such a date.

Any advice?

Request their investigation procedure - but you'll probably get their "standard" reply "we investigate by phone, letter or through an automated system" (SURPRISE! - not smoke signals).

I would then sue Experian for failure to investigate and failure to provide the investigation procedure.

Or, you can take it up with the cell service provider.

Or sue both.

Or just file the law suit, provided you have good documentation.

Unless they notify you in writing that your dispute is "Frivilous" they MUST re-investigate the dispute.

Only when they tell you in writing that it is frivilous and give you a reason are they allowed not to investigate.

I had this same problem with Experian and a Providian account.

I contacted them numerous times by certified mail asking for procedures and letting them know they did not label my dispute as frivilous as required by law.

They ended up investigating and deleting.

Keep at it and be persistant, they would like nothing more for you to take what they are telling you and just add that "100 Word" worthless statement and be gone.

Thanks Tac, I appreciate the advice. That is very good info to know. Experian has just been such a thorn in my butt. I have stepped it up a notch now. I sent them procedure requests, crrr, on monday. I explained in the letter that they could not have verified the account, because I have spoken with numerous people of various management positions at the company in question, and they could not verify the account being charged off. How could they to Experian. I nicely explained this could lead to legal action if it isn't deleted very soon. I will keep you posted.

Experian keeps breaking laws with me right and left. I sent my intent to sue yesterday and gave them until october 2nd to call which of course they will not. I told them I would only accept calls from their legal department. Christine, would you have any emails or phone numbers of anyone in the experian legal department?
