View Full Version : NCO has not replied to validation
Early_Grace
I have 2 collections from NCO on my EQ and TU reports, and I have no idea what they are. The date of last activity they are reporting is less than 2 years ago. Still drawing a blank.
I sent them a request for validation (CRRR) a month ago, with no reply. I have the green card, as well as a copy of the validation letter I have sent them. Since there has been no reply in a "reasonable" amount of time, what should my course of action be? Should I send another request for validation, or send a demand for deletion? By the way, they have not noted on my reports that I have disputed these accounts. I need this off soon, as it is the only bad thing left on my EQ and TU reports...and I am soon to be seeking a first mortgage.
Christine
You need to dispute with the bureaus - a simple "not my account" online will do.
"I need this off soon" -- How soon is soon?

Christine,
The problem is, I have disputed online with EQ and TU. Both of them validated this account as mine. That's why I asked NCO for validation. They still have yet to respond.
By soon, I need this off by mid November at the latest.

Once you request validation, a debt collector does not have to validate as long as he does not attempt any further collection activity. After you request validation, you must force his hand by disputing with the CRA. This makes him choose one of three options:
1. Do nothing. This is a win for you, the account goes away.
2. Validate, if possible and then verify with the CRA. You lose. Almost NEVER happens.
3. Verify with CRA without validation. With or without dispute notice, they still reported. This is a violation. Sue. Hopeful win for you.
Christine
Correct, except that I don't consider an account "going away" to really be a win.
A "win" involves a check it the account is not legit. :)
"By soon, I need this off by mid November at the latest."
You got some time, but better get started on those disputes ASAP.

Update on this account...
I have redisputed with Equifax...to see if NCO will validate again.
I kind of hope they do, because I could use some easy money.
I did the same with TransUnion, but they labeled my request "frivolous" because it was already validated once.
I am not happy about this with TransUnion, and sent them a letter explaining that this isn't my account, never was, and they better reinvestigate it, because NCO has not replied to my validation requests. I have no idea what the problem is. The collection agency has nothing that will validate this account obviously, or they would have sent it. I have not even been notified what this account is in regards to. It is just marked as a collection account on both my EQ and TU reports.
It better be deleted soon, this is ridiculous.

You get that a lot with all bureaus if you recently disputed. Rarely will they refuse a 2nd dispute if it's in writing, I usually fax to the legal department.
And usually I fax the validation request right away - like you said, it's easy money if they verify.

So this address is where they will answer from?
Have you had experience with NCO validating any type of debt?
So far, they have not replied to validation, and verified the 2 collection accounts after my request for validation. I can't even tell you what this account is for....they won't tell me.
I will send another letter to this address, a demand for deletion right away.
Christine
Beats me why anyone would want a response rather than $1,000

Yes, I sent a validation request to John Emmons and he was not able to validate and sent me a letter saying so. If you fax him you'll get an immediate response.
